Terms of Service

These Terms of Service ("Terms") govern your access to and use of Animal Detect, including our web platform, API, documentation, billing pages, and related support services. By creating an account or using the service, you agree to these Terms.

1. Service overview

Animal Detect helps wildlife professionals, researchers, and organisations manage and analyse wildlife imagery and related data through a browser-based platform and a programmable API.

The service is offered as two products:

• Wildlife Monitoring: a shared organisation workspace where images and videos from connected cameras, drones and uploaded archives are processed, reviewed and exported. Licensed yearly per organisation.
• Detection API: programmatic access to our detection models, metered per image.

Every account includes free allowances described in Section 3. Higher-volume needs may be handled through custom arrangements.

2. Billing model

Wildlife Monitoring is licensed per organisation on a yearly basis, quoted individually and invoiced yearly. Licensed organisations may purchase additional upload data through the platform; purchased data does not expire while the account is active. When a licence expires without renewal, the workspace becomes read-only and data handling follows Section 9.

The Detection API is metered per processed image, with no subscription and no minimum. Paid usage requires a payment card on file; metered consumption is charged at the end of each billing month.

Prices and free allowances are shown on our Pricing page, in your quote and at the point of purchase. The price shown or quoted at the time of purchase is the one that applies.

3. Free allowances

Creating an account is free and includes:

• A one-time upload allowance per organisation, with full access to review tooling and exports within the allowance.
• A monthly free allowance of API detections per organisation. Free API usage requires a verified email address, is limited to one free API key, uses synchronous endpoints only, and is subject to lower rate limits.

Connecting cameras and drones requires a licence; discovery runs through a demo. The current size of each free allowance is shown on the Pricing page. Free allowances are provided as-is, may be adjusted with reasonable notice, and may be revoked in cases of abuse, including repeated registrations created to farm trial allowances.

4. Organisations and shared workspaces

Every account belongs to exactly one organisation. When you sign up, an organisation is created for you automatically; you can rename it and invite others. Licences, upload data and free allowances attach to the organisation, not to individual members. There is no per-seat charge and no limit on members.

Members of an organisation share its workspace. Content uploaded to the organisation, connected cameras and processing results are visible to its members according to their role (owner, member or guest) and to the projects the owner has given them access to. Guests can view and download within their projects and cannot change anything. The owner decides who is invited, what each person can see and do, and when their access ends, and can hand ownership to another member. Content a person adds stays with the organisation when they leave.

5. Your content and permissions

You retain ownership of content you submit to Animal Detect. You grant us the rights we reasonably need to host, store, transmit, process, secure, back up and display that content in order to operate the service for you and your organisation.

We do not sell your content or share it with third parties for their own purposes. It is disclosed only to the service providers we need to operate the platform, as described in our Privacy Policy.

Service improvement: unless your organisation turns it off in its settings, we may use copies of your organisation's images and videos, and the labels and corrections added to them, to train, evaluate and improve our detection models. Images and videos in which our models detect people or vehicles are excluded, and location, camera and other metadata is removed first. Turning the setting off stops any further use; models already trained are not affected.

Images in which our models detect people or vehicles are blurred by default (the Privacy Filter). The organisation owner may disable the filter where the organisation has a lawful basis to view such imagery and is responsible for that decision.

You represent that you have the necessary rights and permissions to upload and process the content you submit, and that doing so does not violate applicable law or the rights of others.

Your use of the service is also subject to our Privacy Policy, which forms an integral part of these Terms.

6. Changes, cancellation, and payment failure

• Wildlife Monitoring licences renew yearly by agreement. Cameras can be added mid-term; added cameras are invoiced pro rata for the remaining licence period.
• Upload data purchases are one-time purchases; there is nothing to cancel and purchased data does not expire while the account is active.
• The Detection API has no subscription. You can remove your card at any time: any accrued metered usage not yet billed is shown to you and charged to your card at the moment of removal, after which paid usage stops and the free monthly allowance continues.
• The same applies to account deletion: accrued usage charges become immediately due and are charged to your card before the deletion completes. Billing records (invoices and payment history) are retained after deletion as required by accounting and tax law.

If a payment fails, we retry it following our payment provider's standard retry schedule. For the API, the key is paused after the final failed retry and unpaused immediately when payment succeeds. For licences, we contact you before restricting access.

7. API spend limits

Metered API accounts receive a default monthly spend limit, created when a card is added; the current default amount is shown in your billing settings. You can increase, lower, or remove this limit at any time. When usage reaches the limit, your API keys pause and we notify you; increasing or removing the limit resumes service, and service also resumes automatically at the start of the next calendar month. The limit protects you from runaway scripts; it is not a billing commitment.

8. Payments and refunds

Licences, data purchases, and metered billing are processed by Stripe or another payment provider we designate. Prepaid-funded cards (including disposable and single-use virtual cards) are not accepted for metered card-on-file billing.

If you believe a charge was made in error, contact support@animaldetect.com within 7 days or as required by applicable law.

9. Acceptable use

You may not use Animal Detect to break the law, interfere with service availability, abuse our API, bypass product restrictions or metering, attempt unauthorised access, or upload content you do not have the right to process.

We may suspend or limit access if we reasonably believe your use creates security, legal, operational, or abuse risk.

You may not use the service in violation of applicable export control or sanctions laws, including those of the European Union.

We may monitor usage and enforce rate limits or technical measures to prevent abuse or misuse of the service.

Content you submit and results we generate, across all products, are retained for 12 months after processing unless your organisation deletes them earlier, after which we offer export, renewal or deletion. Aggregated usage, billing, security and compliance records may be retained longer, as described in our Privacy Policy.

10. Indemnification

You agree to indemnify and hold harmless Animal Detect ApS, its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from: (a) your content, (b) your use of the service, or (c) your violation of these Terms or applicable law.

11. Suspension and termination

You may stop using Animal Detect at any time. We may suspend or terminate access if you materially breach these Terms, create abuse or security risk, fail to pay for paid services, or if continued service would create legal or operational risk for us or others.

Termination does not automatically remove records we must keep for billing, security, legal compliance, or legitimate operational purposes.

Upon termination or suspension, your access to the service may be disabled immediately. We may delete or retain your data in accordance with our Privacy Policy and applicable legal obligations.

12. Intellectual property

Animal Detect, including its software, models, design, documentation, and branding, remains the property of Animal Detect ApS or its licensors. These Terms do not transfer ownership of our intellectual property to you.

13. Disclaimers

Animal Detect is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or suitable for every workflow, or that model output will always be complete, accurate, or fit for a specific purpose.

You remain responsible for reviewing outputs and for decisions made based on those outputs. This includes the Privacy Filter: detection models can miss people or vehicles in an image, and the filter cannot blur what the models do not detect.

We do not provide any service level agreement (SLA) unless explicitly agreed in writing.

We are not responsible for any loss, corruption, or deletion of data. You are responsible for maintaining appropriate backups of your content.

14. Limitation of liability

To the maximum extent permitted by law, Animal Detect and Animal Detect ApS will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, or data arising from or related to your use of the service.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to the service will not exceed the amounts you paid us for Animal Detect during the 12 months before the event giving rise to the claim.

15. Changes to the service or Terms

We may update the service, products, or these Terms over time. Material changes will be reflected on this page and, where appropriate, communicated by email or inside the product before they take effect.

16. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labour disputes, internet or cloud service failures, or governmental actions.

17. Contact and governing law

For legal or billing questions, contact info@animaldetect.com or support@animaldetect.com. These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Any disputes shall be resolved in the courts of Denmark.
